1. Agreement to Terms

By accessing or using ATStruggle Buster (the "Service"), including the web application at atstrugglebuster.com and browser extension, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, please do not use the Service.

ATStruggle Buster is operated as an individual project by a developer in Texas, USA ("I", "me", or "my"). This is a hobbyist project aimed at helping job seekers improve their applications.

2. Description of Service

ATStruggle Buster provides an AI-powered resume evaluation service that compares job descriptions against user resumes to calculate ATS (Applicant Tracking System) compatibility scores. The Service includes:

• Web application for resume upload and management
• Browser extension for on-page job description evaluation
• AI-powered analysis and scoring using OpenAI's API
• Credit-based evaluation system
• Evaluation history tracking

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account using Google OAuth authentication. You are responsible for maintaining the security of your account and for all activities that occur under it.

3.2 User Eligibility

The Service is intended for job seekers of any age who can legally enter into contracts in their jurisdiction. If you are under 18, you should have parental permission to use the Service, especially for any purchases.

3.3 Account Termination

I reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful activities. You may delete your account at any time as described in our Data Deletion Policy.

4. Credits and Payment

4.1 Credit System

Each resume evaluation consumes one (1) credit. Credits must be purchased in advance through packages.

4.2 Pricing

Current credit packages and pricing are displayed on the website. Prices may change for future purchases with reasonable notice.

4.3 Payment Processing

All payments are processed securely through Stripe. By purchasing credits, you agree to Stripe's terms of service.

4.4 Refund Policy

Credit packages are final sale and non-refundable. However, if you experience a serious quality issue with a specific evaluation (such as a technical error that provides incorrect results), I may refund that individual credit at my discretion. Please contact me within 48 hours of the issue with details.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purposes
• Upload malicious code or attempt to hack the Service
• Share your account or API keys with others
• Attempt to circumvent the credit system
• Use automated tools to overload the Service
• Upload inappropriate or offensive content
• Impersonate others or provide false information
• Resell or redistribute the Service

6. Intellectual Property

6.1 Service Content

The Service's code, design, and content (excluding user uploads) are my property or licensed to me. The project is partially open-source on GitHub.

6.2 Your Content

You retain ownership of your uploaded resumes and content. By using the Service, you grant me permission to process your content solely for providing the evaluation service. Your content will not be shared with others or used for any other purpose.

6.3 Feedback

Any suggestions or feedback you provide may be used to improve the Service without obligation to you.

7. Privacy

Your use of the Service is also governed by the Privacy Policy, which describes how information is collected, used, and protected.

8. Disclaimers

8.1 No Employment Guarantee

The Service provides algorithmic evaluations for guidance only. I cannot guarantee job placement, interview success, or that the scores accurately predict real ATS behavior. Different ATS systems work differently.

8.2 Service Availability

As a hobbyist project, the Service is provided "as is" and "as available." I cannot guarantee 24/7 uptime or immediate support. The Service may be modified or discontinued if it becomes unsustainable.

8.3 Third-Party Dependencies

The Service relies on third-party services (OpenAI, Google, Stripe, Vercel). I am not responsible for their outages or changes that may affect the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

MY TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE PAST 12 MONTHS.

This is a hobbyist project provided in good faith to help job seekers. Please use it as one tool among many in your job search.

10. Indemnification

You agree to indemnify and hold me harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of Texas, USA. Any disputes shall be resolved in the courts of Texas.

12. Changes to Terms

I may update these Terms as the Service evolves. Significant changes will be announced on the website or via email. Continued use after changes constitutes acceptance.
