1. Agreement to Terms

By accessing or using ATStruggle Buster (the "Service"), including our web application at atstrugglebuster.com and browser extension, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

ATStruggle Buster provides an AI-powered resume evaluation service that compares job descriptions against user resumes to calculate ATS (Applicant Tracking System) compatibility scores. The Service includes:

• Web application for resume upload and management
• Browser extension for on-page job description evaluation
• AI-powered analysis and scoring
• Credit-based evaluation system
• Evaluation history tracking

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account using Google OAuth authentication. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.2 Account Responsibilities

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use
• Accept responsibility for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

4. Credits and Payment

4.1 Credit System

The Service operates on a credit-based system. Each resume evaluation consumes one (1) credit. Credits must be purchased in advance and are non-refundable except as required by law.

4.2 Pricing

Current credit packages and pricing are displayed on our website. We reserve the right to modify prices with 30 days' notice to existing users.

4.3 Payment Processing

All payments are processed securely through Stripe. By purchasing credits, you agree to Stripe's terms of service and privacy policy.

4.4 Refund Policy

Credits are non-refundable once purchased. However, we may provide refunds at our discretion for technical issues that prevent service usage.

5. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe upon intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to the Service
• Harass, abuse, or harm other users
• Engage in automated or excessive use that burdens our systems
• Resell or redistribute the Service without authorization
• Upload false, misleading, or inappropriate content
• Circumvent credit requirements or payment systems

6. Intellectual Property

6.1 Service Content

All content, features, and functionality of the Service, including software, text, images, and logos, are owned by ATStruggle Buster or its licensors and are protected by intellectual property laws.

6.2 User Content

You retain ownership of content you upload (such as resumes). By uploading content, you grant us a limited license to process and analyze it for the purpose of providing the Service. We will not share your content with third parties except as necessary to provide the Service or as required by law.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimers and Limitations

8.1 No Guarantee of Results

The Service provides algorithmic evaluations based on keyword matching and AI analysis. We do not guarantee job placement, interview success, or accuracy of ATS predictions. Results should be used as guidance only.

8.2 Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. We reserve the right to modify or discontinue the Service with reasonable notice.

8.3 Third-Party Services

Our Service relies on third-party providers (OpenAI, Google, Stripe). We are not responsible for their availability, accuracy, or performance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATSTRUGGLE BUSTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to indemnify and hold harmless ATStruggle Buster, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ATStruggle Buster regarding the use of the Service.
